Mum who accidentally smothered baby sues hospital for $8.6m

She filed an $8.6 million lawsuit against the hospital. Jacob was 10 days old. The suit alleges a nurse at Portland (Ore.) Adventist Medical Center took Ms. Thompson's baby, Jacob, from the hospital's nursery to Ms. Thompson's room for breastfeeding around 3 a.m. on August 6, 2012.

"About an hour later, still drowsy and groggy, Mrs. Thompson noticed her son was unresponsive in her arms", the lawsuit states. When she touched his eyes, talked to him, and poked him, she did not get a response, according to the lawsuit against the hospital. She called for assistance as she tried to revive her son however when noone came to help, Thompson carried him into the hallway, where she was able to attract the attention of a nurse.

The baby, who never regained consciousness, died seven days later when his parents turned off his life support after he placed in intensive care. In her legal filing, Thompson said the hospital was negligent for giving her the baby to breastfeed while she was taking such strong pain medications and also for leaving them alone while she was in such a groggy condition, Oregon Live reports.

The suit seeks damages for the baby's "desperation and anxiety" as he was suffocated and his mother's "severe emotional distress upon unintentionally killing her firstborn child". "But their biggest hope is that other hospitals don't do this and it can set clear policies for their nurses to avoid something as senseless as dropping off a child for breastfeeding to a mom loaded with narcotics and painkillers". Unless of course, Thompson wasn't on the narcotics and sedatives she claimed she was or the hospital egregiously erred by allowing her to breastfeed under the influence in the first place?

Monica Thompson, 42, gave birth to a healthy baby boy via C-section on August 2 in 2012.

The hospital has released a statement, as well, noting, "This was a tragic event and our thoughts and prayers continue to be with the family". The suit also seeks compensation for Monica Thompson's counseling expenses for depression and post traumatic stress disorder. "Adventist Medical Center is committed to providing quality, compassionate care to all of our patients".

About 3,500 babies die each year in the United States because of "unsafe sleep environments", such as suffocation or strangulation; some die of sudden infant death syndrome (SIDS), according to the American Academy of Pediatrics.

She also alleges she and the baby were left unsupervised for an hour.
