Rifle believed to be used by Ian McCarthy recovered

Authorities say he shot and killed Michael Sunday night during a traffic stop.

Investigators have said that Michael was killed when the driver of a vehicle he stopped for a traffic violation in Clinton Sunday jumped out and shot him. Lowe says that during the course of an interview, investigators determined that the 35-year-old Noble had disposed of the rifle believed to have been used in the officer's killing.

Lowe says he couldn't immediately specify the style of the rifle or how investigators came to find it. He's charged with first-degree murder and felony armed criminal action.

After being taken into custody Tuesday evening, McCarthy was transported to a Kansas City hospital for treament, before being returned to the Henry County Jail at 12:19 a.m. Wednesday.

Police say he then changed his story and admitted he bought the gun for McCarthy who had asked him to do so.

Noble initially told two officers who visited his home on Thursday that he bought the rifle and sold it to McCarthy. Police say they told Noble that he already knew the answer to that question.

The court documents indicate Noble gave police a written statement about buying, then later selling the gun to McCarthy.

Police asked Noble if he knew where the gun now was.

"Noble said he panicked, told his wife he needed to take out the trash, took the gun and drove north of town", according to the affidavit. He then went with officers to the intersection of NW 300th Road and NW 131st Road.

A memorial service for Michael will be held Saturday morning at the Benson Convention Center in Clinton, according to the Vansant-Mills funeral home website.

The prosecutor said he's considering more charges against Noble and whether to seek the death penalty against McCarthy. As Officer Michael exited the patrol vehicle to make contact with McCarthy, he's accused of firing a round towards the officer, fatally striking him.
