Cannot Deport Rohingya Refugees Till Next Hearing, Supreme Court Tells Government

Hearing a petition against deporting Rohingya people from the country, the Supreme Court today called the Rohingya situation in Myanmar a "huge humanitarian crisis", but stopped short of freezing a plan to expel the refugees after the centre pleaded that a stay order could have global ramifications. It further rapped the government saying that there is a need to strike a balance between human rights and national security.

The Supreme Court said on Friday that the human rights of Rohingya refugees can not be ignored and there is a need to "strike a balance" when it comes to issues of national security resulting from their stay. It, however, allowed petitioners to approach it in case of contingency.

The SC said the Rohingya Muslims issue is of great magnitude and the State has a big role to play. "Moreover, India's credibility as a net security provider for our neighbours in the region would be severely compromised if we fail to act on behalf of our broader interests in the region", they said. "The issue involves human rights of many", the bench said.

Two Rohingyas had filed a petition in the top court challenging their deportation.

The hearing was done by a three-judge bench headed by Chief Justice, Dipak Misra.

Another Rohingya refugee then filed an affidavit in the Supreme Court denying the Indian government's claims that the Muslim community from Myanmar has terror links with Pakistan's Inter-Services Intelligence (ISI) and the Islamic State. The petition argues that deportation would violate their human rights.

In an affidavit filed in the apex court registry, the NDA government said the fundamental right to reside and settle in any part of the country is available to citizens only and illegal refugees can not invoke the jurisdiction of the Supreme Court to enforce the right.

Currently, there are around 14,000 Rohingya refugees living in the country who have fled their country after the Myanmar security forces resorted to violence against Rakhine state in the process of taking action against terrorists who attacked police posts.

Close to 40,000 Rohingya Muslims live in India after fleeing Myanmar over the past decade.
