High Court rules in favour of Apple's plan for Athenry data centre

Tech giant Apple can now proceed with its €850m data centre in Athenry as the Commercial Court in Dublin has backed An Bord Pleanála's original decision to grant planning permission.

The objectors are two local residents who cite environmental concerns about the proposed facility, which would be situated in Derrydonnell Forest, around three miles from Athenry.

The ongoing delays regarding the company's planning permission have led the national government to review its planning proposal scheme and put changes in place to fast track data centre projects which are crucial to build Ireland's future as an European data centre up-Tier city.

The project, which was first announced more than two- and-a-half years ago, would be the biggest private investment in western Ireland. The case will return to the courts on Monday, where it will be decided whether or not a further appeal can be made against Apple.

The court refused a second challenge, pursued by local businessman Brian McDonagh about the project's conservation impacts on the area, and described it as "without substance" in the full 18-page judgment seen by Computer Weekly. Projects that benefit society and the economy must be prioritised.

Athenry for Apple founder Paul Keane, who attended the court today, claims that Daly and Fitzpatrick's legal teams initially sought leave of a couple of weeks to mount an appeal, and he views the fact that this request was not granted as a positive sign.

The data centre is expected to cost €850 million (£762 million) and create over 100 new jobs. "It now means the town can get to work on making the project a vital part of our town's infrastructure and its workforce a welcome addition to our local community", he said.

"Today's decision has been a great decision for Athenry and the whole west of Ireland", he said.

Orla Casey is a planning and infrastructure policy executive for IBEC, and says the case has damaged Ireland's reputation overseas.

"It all points to a need to reform our planning laws so that important infrastructural development such as this do not get caught up in years of objections and appeal after appeal".
