Lawsuit Alleges Calif. Tesla Factory is a 'Hotbed For Racist Behavior'

Jose Moran - who claimed to be an employee at the Fremont factory - wrote a scathing critique of the facility and his employer, alleging "excessive mandatory overtime" and low wages.

An October lawsuit over racial discrimination also described a work environment where racial slurs were common.

Tesla did not immediately respond to a request for comment on the lawsuit, which was filed November 13 at California Superior Court in Alameda County.

Tesla Motors (NASDAQ:TSLA) is being accused of allowing its California production plant to become a "hotbed for racist behavior".

The proposed class-action suit alleges a racist culture at Tesla, unsafe factory conditions, and failure on the part of the company, including CEO Elon Musk personally, to prevent or investigate race-based harassment and discrimination there.

Tesla has not responded to reporters' request for comment about the lawsuit.

The assembly line worker says supervisors and co-workers routinely used the racial slur against him and other black employees but no investigation was conducted, even after he made a written report to Tesla human resources. Vaughn said he sent complaints to the human resources department, as well as CEO Elon Musk, but was sacked on October 31 for not having a "positive attitude".

Vaughn stated that although the company is considered an innovative company and the pioneer of the electric vehicle revolution, its standard operating procedure "is pre-Civil rights era race discrimination". The lawsuit seeks class-action status and unspecified damages under California anti-discrimination law.

Shares of Tesla closed down 2.1 percent on Tuesday afternoon following news of a civil rights lawsuit against the automakers. "In fairness, if someone is a jerk to you, but sincerely apologises, it is important to be thick-skinned and accept the apology".

His legal complaint included a memo it said was from Tesla CEO Elon Musk to employees.

According to the complaint, Musk sent an email to Tesla employees in May, a month after Vaughn started work, which gave mixed messages: "Part of not being a huge jerk is considering how someone might feel who is part of [a] historically less represented group", the suit claims the email said. "Sometimes these things happen unintentionally, in which case you should apologise".

In February, an ex-employee named AJ Vandermeyden filed a discrimination lawsuit against the company, stating she had been the victim of repeated instances of sexual harassment and that she was paid less than her male counterparts.

Overloaded with such allegations and lawsuits, Tesla is prepping to launch its semi truck on Thursday of this week.
