'While the Law Council does not endorse every detail of the Smith Bill it represents a better balance from a human rights perspective and represents greater fairness, including those affected by winding back anti-discrimination laws, ' Ms McLeod said.

The debate on the Smith bill is expected to start on Thursday and carry through to the next parliamentary sitting week, beginning in late November.

"If the Australian people do vote "yes", they're not going to look kindly on the same group of people who have urged a "no" vote not accepting the outcome and trying to delay further", she said.

David Kalisch, the head statistician at the Australian Bureau of Statistics (ABS), and his deputy, Jonathan Palmer, will hold a media conference at ABS house in Belconnen (a suburb in Canberra), where they will announce whether the majority of people who returned their surveys voted "yes" or 'no'.

Mr Goodenough said the alternative Bill could also be introduced into the Senate this week.

"There is no apology for the fact that the Bill does not address free speech or parental rights - because it's a Bill about marriage equality".

Freedom of speech is also covered in the proposed bill, with the senator arguing that people should be able to say whatever they like about same sex couples as long as it was not harassment or threatening.

The bill will be introduced by Smith, who will be joined by Liberal senators Linda Reynolds and Jane Hume, as well as Labor's Penny Wong and Louise Pratt, the Greens' Richard Di Natale and Janet Rice, Skye Kakoschke-Moore from the Nick Xenophon Team and Derryn Hinch.

"In time, there will be no Christmas or Easter".
