Sandy Hook families make last-ditch plea to save gunmaker suit

Families of victims of the 2012 Sandy Hook massacre asked a court on Tuesday to revive a lawsuit against Remington Arms Company over whether the gun manufacturer bears any responsibility for the mass shooting, Bloomberg reported.

Attorneys for the family argued in court documents and in the Connecticut Supreme Court in Hartford on Tuesday that an exception to the 2005 law allows lawsuits against companies that know or should reasonably be expected to know that their products are likely to be used "in a manner involving unreasonable risk of physical injury to the person or others".

The Sandy Hook families' case rests on whether the company negligently entrusts a buyer with a weapon, which is an exception to the federal law.

"The weapon he needed for his mission was never in doubt", the families' attorney Josh Koskoff said.

The killings at the Sandy Hook elementary school in CT - which claimed the lives of mostly children aged between six and seven in less than five minutes shortly before Christmas - shocked America and reignited the national debate about gun control.

The families of nine of the victims and one survivor have said manufacturer Remington Arms Company Inc [REARM.UL], along with a gun wholesaler and local retailer, should be held responsible for the carnage at the Newtown, Connecticut, school because they marketed the weapon based on its militaristic appeal.

If the Sandy Hook families are successful, Timothy Lytton, a law professor at Georgia State University, said he would expect the U.S. Supreme Court to take up the case.

A lower court threw out their case previous year. "No matter how much we wished those children and teachers were still alive, the law needs to be applied", Vogts told justices.

"The manufacturer and the sellers of the firearms used by the criminal that day are not legally responsible", Vogts said.

After today's hearing, the families say they have full faith in the justice system, but it's a tough legal road for them because of that federal immunity.
