Canada complains to WTO about USA trade duties

U.S. Trade Representative Robert Lighthizer called the move "an ill-advised attack" on the American system for monitoring foreign trade.

Chad Bown, an economist and trade expert at the Peterson Institute in Washington, said Canada's WTO move sends a stark message to Mr. Trump amid NAFTA talks: If you kill the deal, this is how Canada will fight you in trade disputes. The association applauded the efforts of Democratic and Republican U.S. Senators, and the publishers of over one thousand small and medium-sized U.S. newspapers who have demanded that Washington not impose countervailing and anti-dumping duties on Canadian newsprint.

Canada's first motivation for going to the WTO is to show the Americans (and the rest of the world) that it will not cave in to its larger economic partners when they put undue pressure on Canadian economy and businesses.

Canada appeared to be mounting a case on behalf of the rest of the world, since it cited nearly 200 examples of alleged US wrongdoing, nearly all of them concerning other trading partners, such as China, India, Brazil and the European Union. But he questioned the strategic logic of antagonizing the Trump administration in the midst of NAFTA talks.

On Wednesday, the Canadian government announced it had submitted a request for consultations at the World Trade Organization (WTO) to challenge the United States' countervailing and anti-dumping duties.

The wide-ranging trade dispute, which was filed with the WTO in December and released publicly on Wednesday, is mostly in response to the steep anti-dumping and countervailing duties that the United States has recently slapped on Canada's softwood lumber industry.

If these countries can defend and promote their own interests, why shouldn't Canada? Even if Canada succeeded with their claims, other countries would primarily benefit, not Canada, Lighthizer argued. "But with the Trump administration being relatively new, and because of the protectionist noises we've been hearing from them, it's not at all clear what sort of reaction the USA might have".

"For example, if the USA removed the orders listed in Canada's complaint, the flood of imports from China and other countries would negatively impact billions of dollars in Canadian exports to the United States, including almost US$9 billion in exports of steel and aluminum products and more than $2.5 billion in exports of wood and paper products", he said.

While Canada continues to hope for the best from the NAFTA renegotiation, Freeland says it is also preparing for the worst-case scenario - a decision by President Donald Trump to withdraw from the three-way, continental trade pact.
