Radiohead sue Lana Del Rey for 'copying Creep'

Lana later appeared to confirm the reports, tweeting: "It's true about the lawsuit". She said that while her song "wasn't inspired by Creep", she has offered up to 40% of the publishing to settle the matter.

The 32-year-old singer is now preparing to remove the song from her latest album, Lust for Life, if she loses the legal battle with Radiohead. "So we will deal with it in court".

Radiohead have not commented. The statement would seem to indicate that Hammond and Hazelwood would be given a percentage of the "Get Free" publishing as well if Radiohead's effort is successful. "Those sentiments I wrote, I really am still going to strive for them", she explained, "even if that song is not on future physical releases of the record".

They subsequently co-credited Albert Hammond and Mike Hazelwood, who wrote the 1974 hit, on their debut album Pablo Honey, and reportedly gave them a cut of the royalties.

While this legal action will prove a hindrance for Lana del Rey and her legion of fans, she's far from the first artist to be embroiled in copying claims. To win a copyright infringement suit, the band's lawyers would have to persuade a jury that Del Rey's song is "substantially similar" to "Creep", both qualitatively and quantitatively. The judgment, which threw out the case, included lyrics penned by the music star herself, such as: "the court is not saying that [the claimant] can never, ever, ever get his case back in court", a reference to Swift's hit We Are Never Ever Getting Back Together.
