Judge invalidates state aid-in-dying law; appeal window is narrow

But in comments during last year's hearing quoted by opponents, Ottolia said the right-to-die law did not appear to be "related to improving the health of Californians", Brown's stated overall goal for the session.

A county judge in California has struck down the state's physician-assisted suicide law, ruling that lawmakers wrongfully glided the bill through during a special legislative session that was to have focused on Medicaid funding, services for the disabled and in-home healthcare services.

The legislation gained new support in California from the plight of Brittany Maynard, a 29-year-old schoolteacher from Alamo who was diagnosed with brain cancer in 2014.

"We are hopeful that the state accepts this decision and that the matter is referred back to the Legislature for further consideration", Larson said. Senate Majority Leader Bill Monning's office said Monning is talking with the Becerra's office about options to preserve the law.

"T$3 he End of Life Option Act does not fall within the scope of access to healthcare services", Ottolia ruled. "For too many, assisted suicide will be the only affordable "treatment" that is offered them".

In the first and only report to date, the California Department of Public Health reports that in the second half of 2016, 191 terminally ill patients received aid-in-dying drugs; of those, 111 patients died using them. Five California physicians and the American Academy of Medical Ethics brought the legal challenge. The resolution called on churches and Christians "to care for the elderly among us, to show them honor and dignity, and to prayerfully support and counsel those who are providing end-of-life care for the aged, the terminally ill, and the chronically infirmed".

Bulgaria and Poland, which have also failed to take action, have already been taken before the top court. The Commission said it was standing up for the right of citizens to breath clean air.

The California law, which went into effect in 2016, allows terminally ill patients who have been given a prognosis of six months or less to live to obtain a prescription for a lethal dose of medication.

Critics of assisted suicide charge the practice is not only potentially abusive, but it already is being used in place of health care. Two doctors have to sign off on the patient's prognosis, and the patient must make the request for lethal medication once in writing and twice verbally, with at least 15 days between the requests. Gen. Xavier Becerra said: "We strongly disagree with this ruling and the state is seeking expedited review in the Court of Appeal".

Life Legal filed a motion for judgment on the pleadings in March 2018, arguing that the law should be overturned because the manner in which it was passed is unconstitutional.

Worse, for patients, "the so-called right to die very quickly becomes the duty to die", Stevens said.

"Just as assisted suicide contravenes the Hippocratic oath, the judge found that the California legislature contravened the state constitution", stated CMDA CEO Dr. David Stevens. Life Legal attorneys appeared in court this morning to argue that the End of Life Option Act, which decriminalizes physician-assisted suicide, is not related or even incidental to the stated goal of the special session. "Brown, the attorney general and the courts to keep this law in effect", said Maynard's husband Dan Diaz, in a prepared statement.

"I'm still passionate about this issue because I don't want to see people die badly".
