Judge rules 30-year-old-son must move out

In a real-life case of "failure to launch", an upstate NY couple got so fed up with their unemployed 30-year-old son's refusal to leave home that they finally sued to evict him.

A NY couple have won their legal battle to evict their 30-year-old son from home after he refused to leave.

A 30-year-old man didn't get the message that it was time to move out of his parents' home, even after they left him five notices and an offer of cash to help find new digs.

Mark and Christina Rotondo first asked Michael to move out of the family home in Camillus, upstate NY, in February, giving him 14 days to leave.

The written notices given to Rotondo included an offer to give him $1,100 to help him find a place to stay, a request that he sell anything he owns of significant value, including weapons, and an offer to pay for the repairs of a broken auto left on the parents' property.

Eleven days later another letter was sent: "Michael Joseph Rotondo, You are hereby evicted from 408 Weatheridge Drive, Camillus, New York effective immediately", it reads.

The family's home in Upper State New York. "They don't provide laundry or food", said Michael Rotondo.

The parents filed an official eviction petition on May 7.

Rotondo has been living with his parents, Mark and Christina, for eight years. In court, Michael Rotondo argued that he was entitled to six months notice, a point Greenwood explained only applied to landlord-tenant contracts. But Rotondo wasn't going to leave without a legal battle.

"I would say that I'm really not a member of that demographic that they're speaking to", Rotondo said about millennials. He called the ruling "outrageous" and indicated he would appeal the decision.

Rotondo's parents went so far as to even offer to pay for their 30 year old son's health insurance, with Rotondo explaining that he couldn't take that money because it would compromise getting the "poor person" status.

"It sounded kind of like that [to me], too", Rotondo said. I have plans to not stay with them anymore - just not today, just not in 30 days.

They do tell their son to get a job and move his broken-down auto.
