U.S. reaches deal with China's ZTE, commerce secretary says

Commerce Department spokesman James Rockas told Reuters on Tuesday that "no definitive agreement has been signed by both parties". ZTE also exported similar material to North Korea.

The sources requested anonymity because they were not authorized to publicly discuss the matter.

The deal, announced by US Commerce Secretary Wilbur Ross, will mean the end of a ban on ZTE buying American parts, provided the state-controlled company sticks to the terms. The US agency and the Chinese company signed off on "all 23 pages" of the agreement, he said. "It's unprecedented to have U.S. agents as monitors ..."

The terms outlined by Reuters are similar to the those Trump outlined in a May 25 tweet, saying that ZTE might reopen "with high level security guarantees, change of management and board, [and it] must purchase USA parts and pay a $1.3 Billion fine". It also requires ZTE to change its board of directors and executive team in 30 days. The arrangement takes place in the midst of an environment of growing trade tensions between Washington and Beijing, following the threat of Trump to impose tariffs of 150 billion dollars on Chinese imports, and the decision of the Asian giant to adopt reciprocal measures.

The US government has agreed a deal with Chinese smartphone and telecommunications network equipment manufacturer ZTE that will allow it to continue to trade with American firms.

The company was found to have shipped its sophisticated telecommunications equipment to both nations and to have repeatedly lied to USA investigators about its actions.

ZTE is based in Shenzhen, close to Hong Kong, and was founded in 1985. Following that agreement, ZTE was found to have paid out bonuses to a number of employees instead of disciplining them as previously agreed.

ZTE has already paid a $1.19 billion fine for violating United States sanction. Their function will be to monitor ZTE's compliance with USA export control laws. For this "pattern of deception, false statements, and repeated violations", the US Commerce Department issued the ban in April. It was blocked from purchasing parts from US companies, sanctions that had crippled the company.

The agreement is likely to draw criticism from some USA lawmakers, who note intelligence agencies have warned ZTE's technology and phones pose a major cybersecurity threat.

The denial order put ZTE's future into jeopardy because it relies on US components for so many of its products.
